Welcome to Tandem Community (“Tandem,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of the Tandem Community website at beintandem.co, our digital health platform, mobile applications, and related services (collectively, the “Service”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not access or use the Service.

2. Description of Service

Tandem Community provides a digital health platform that connects healthcare providers with clinical decision support tools for mental health care delivery. Our Service includes AI-powered clinical decision support, remote therapeutic monitoring (RTM) tools, patient engagement resources, and educational content.

3. Medical Disclaimer

The Service is designed to support, not replace, the relationship between healthcare providers and their patients. The clinical decision support tools provided through the Service are intended to supplement professional medical judgment, not substitute for it. Healthcare providers are ultimately responsible for all clinical decisions regarding patient care.

Nothing in the Service should be construed as medical advice to patients. Patients should always consult with their healthcare provider regarding any medical conditions or treatment options.

4. User Accounts

To access certain features of the Service, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

5. HIPAA Compliance

Tandem Community is committed to protecting the privacy and security of protected health information (PHI) in accordance with the Health Insurance Portability and Accountability Act (HIPAA). Healthcare provider organizations that use our Service will be required to enter into a Business Associate Agreement (BAA) with Tandem Community.

6. Intellectual Property

The Service, including all content, features, and functionality (including but not limited to all information, software, text, displays, images, and the design, selection, and arrangement thereof), is owned by Tandem Community, its licensors, or other providers of such material and is protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

7. Limitation of Liability

To the fullest extent permitted by applicable law, Tandem Community shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party on the Service; or (c) unauthorized access, use, or alteration of your transmissions or content.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.

9. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by posting the updated Terms on this page with a new “Last Updated” date. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.
